In Texas, “custody” is called conservatorship, and it comes in two forms:
Joint Managing Conservatorship (JMC)

How Does a Judge Decide Custody?
Texas courts use the “best interest of the child” standard. Parents are encouraged to reach an agreement outside of court. If they can’t, the judge will consider:

- Each parent’s ability to care for the child
What Visitation Rights Do I Have?
If parents can’t agree on a schedule, the court usually assigns a Standard Possession Order. It usually includes:
- Thursday evening visits
- 1st, 3rd, and 5th weekends
- Alternating holidays
- 30 days in the summer
If there’s a safety issue, the court may order supervised visitation. Additionally, if the child is under the age of 3, the court may order a modified possession schedule.
Can I Deny Visitation if the Other Parent Isn’t Paying Child Support?
No. Child support and visitation are handled separately. Denying visitation violates court orders and could result in penalties.
Likewise, a parent who is being denied access to their child must still pay support.
