Family Law Mediation​

There is a common misconception that family law disputes can only be resolved in court.  This is not true.  In fact, most family law cases are settled in mediation or some other form of alternative dispute resolution.

Mediation is a process where parties talk out their issues and reach an agreement with the help of a neutral third party, a mediator.  During mediation, the parties are given an opportunity openly discuss their family issues, discuss their concerns, and negotiate the terms of the agreement that will work for everyone.  The mediator does not represent either party and their job is to encourage and facilitate a meaningful communication between the parties.  Both parties are welcome to have an attorney present during the mediation. 

Mediation vs. Litigation​

Choosing to settle your family related disputes during mediation rather than litigating your case in court has several advantages.  First, both parties have the opportunity to voice their concerns in a friendly, non-intimidating environment.  The stress for all parties involved will be significantly less in mediation because arguing in court takes time, patience, and money.  Second, rather than having a complete stranger, such as a judge, decide what is in the “best interest” of your children, the parties can reach an agreement that will work for their family and their situation.  Lastly, you will save a ton of money in legal fees by reaching an agreement without the help of the court.  Keep in mind that settling your case in court will require several trips to the courthouse, the filing of numerous documents in court, and a ton of communication with your attorney and the opposing side.  These will be costs that you will be responsible for paying.

Considering these cost factors, the benefits of mediation definitely outweigh the benefits of litigating your case in court. 

Is Mediation for You?

Mediation works best when parties can cordially speak with each other to amicably resolve their dispute.  A successful mediation is not possible without the cooperation of both parties.  It is important for both parties to come into the mediation with a positive attitude and a good-faith commitment to participate in the mediation.
